The three accused pledge not guilty .
On the hearing the prosecutor lead to dated 13 December 2004
the time was 10 P.M. approximately, Police captain Prathaung Tangon
of Narcotic Suppression Bureau had been informed by his commander
about the first accused who lived nearby Soi Petchkrasem 48th was on methamphetamine trafficking which linked to the connection in Re-
public of the Union Myanmar,while on the road using the black Honda- accord with licensed plate วล -1933 Bangkok as transportation for
trafficking. Then captain Prathaung Tangon observed the apartment
where the first accused live but he did not find him.nor the car. By 13.00 P.M.his commander had ordered captain Peathuang Tangon changed his observing place to Lotus department store at Bangyai branch then, the
group by captain Prathuang Tangon took off to the said place. When they arrived, they found the car with license plate วล-1933 Bangkok
Metropolitan had been there, for a while the third accused who was
a driver got off the suspected car where the second accused had sat
in front next to the driver. Then the third accused walked to the front
of the department store he had met and talked to the first accused with
other man. It had been a while, the first accused and the other man follow
the third accused to the suspected car and dove off by him. Then captain
Prathuang and his men had driven to follow the suspected car about two kilometers the suspected car parked near the paned pork shop called Thanapol, By then the three suspects got out the car and the other man who still remained in the suspected car had taken off, as the three accused have been seated in the noodle shop. It had been for half an hour the other man drove back stoped at the noodle shop picked up the three accused into the suspected car and took off this had been about three hundreds kilometers distant as the car stopped to let the other man out, then the second accused had replaced as driver and took off. At Wangnoi territory of Ayudhaya province the captain and his men followed the suspects but missed them, then he had informed his commander and still following the suspects.
Police captain Prathuang Tangon still followed the suspects since he had the news that his chief called the precint 2 of highway patrol to help blocking the suspected car until he reached the place of incident. There he found police captain Jareonpong Santilo and police sergeant Chotiphat Srijareon and their men from the precint 2 of highway patrol had found the three accused with the suspected car brok down along the Mittrapahp highway 0n the out bound location KM 115-116 posts. Captain Jareonpong and his men had shown as police enforcing law and found out they were in suspicious condition.
Then he ordered to checked it out, with that they had found twenty packages of methamphetamine in the strapped handles blue bag container laid in the trunk of suspected car. Arrested the three suspects and seized of methamphetamine in the strapped handles blue
bag container and a suspected car and two mobile phones as assets of evident. As in the arrest and interrogation proceeds charged the three
accused of common culprit, the illegal possession and trafficking the first category drug methamphetamine. In the arresting procedure, the first and second accused pledged guilty but the third accused denied the charges. In the interrogation procedure the first accused pledged guilty but the second and third accused denied the charges. When the interrogation officer send the seized evidence to analyst the report shown methamphetamine of first category drug for the amount of 199.600 pills in the equivalent of 873,506 grms of concentrated substance.
The first accused testified that he knew the second and third while he had worked at the Grand hotel as glass installer, previously to the incident the second accuse called him for an appointment dictated him to go to Saraburi province to measure the room to be panal with yipsom wall for the sound proofed room. On the incident date the second accused drove the black Honda accords license plated วล-1933 Bangkok metropolitan with the third accused to pick up the first accused at his residence In Soi Petchakasem 48 th, he had stopped on the way at Lotus department store,Bangyai branch with the third accused wanted to buy CD disc and the first accused also wanted to buy a shirt, the second accused parked in front of the store area and he waited in the car. After a while they takeoff at the Lotus department store at Bangyai branch and eat out at somtum vendor,when finished heading nonstop to Saraburi province until they have passed the Saraburi province the car incidently broke down. The second accused stopped at Jet service station, for a moment the car restated and keep going. The car had broken down again this was the location where the incident taken place. The second accused stopped the car along the road side in order to contact tow-car, while waiting there was a high way patrol police car, the second accused waved for the police car to stop and help, The police came along and asked to proceed the search inside the car and found methamphetamine evidence that lead to the arrested of the three accused. In the arrest procedure the first accused did not pledge guilty not testified as it appeared on the police arrested report as in document evidence no.; จ 4 , the police report maker had been told by the first accused but the report
not accurate, due to the first accused had spoken before he
signed on the police report as it appeared to be on the document
n evidence จ11 and in the affidavit document evidence จ20
because the police report maker had said
..."it will not have been causing any matter in court".
